Please read these Terms and Conditions carefully before using siac.com.au or purchasing any product. By accessing this website or completing a purchase, you agree to be bound by these Terms in full.

1  About SIAC and This Website

SIAC (Strategic Intelligence & Advisory Compliance) is an AML/CTF advisory practice based in Melbourne, Victoria, Australia. SIAC operates the website siac.com.au (the Website) through which it publishes compliance resources and sells white-label AML/CTF program templates and related digital products (Products) to professional services firms and compliance practitioners.

1.1  What SIAC Is and Is Not

SIAC is an AML/CTF advisory practice. SIAC is not a law firm, does not practise law, and does not hold an Australian Financial Services Licence (AFSL). Nothing on this Website or in any Product constitutes legal advice, financial advice, or regulated professional services advice of any kind.

1.2  Scope of These Terms

These Terms and Conditions (Terms) govern:

  • your access to and use of the Website, including all content, resources, and materials published on it;
  • your purchase of any digital Product made available through the Website; and
  • any interaction with SIAC through the Website, including contact form submissions, enquiries, and newsletter subscriptions.

These Terms apply to all visitors, browsers, registered users, purchasers, and any person accessing the Website from any device or location.

1.3  Related Documents

These Terms should be read together with SIAC's Privacy Policy and the Product Disclaimer that accompanies each template. Where there is any inconsistency, these Terms prevail for platform and transaction matters, and the Product Disclaimer prevails for the use of template documents.

2  Acceptance of Terms

By accessing the Website, browsing any content, submitting a contact enquiry, creating an account, or completing a purchase, you unconditionally accept these Terms and agree to be bound by them.

If you are using this Website on behalf of a business, partnership, or other entity, you represent that you have authority to bind that entity to these Terms, and references to "you" in these Terms include that entity.

If you do not accept these Terms, you must not access or use the Website or purchase any Product.

2.1  Capacity

By using this Website you represent that:

  • you are at least 18 years of age;
  • you have legal capacity to enter into a binding agreement;
  • if purchasing on behalf of a business entity, you have authority to do so; and
  • you are not accessing the Website in a jurisdiction where doing so is prohibited by law.

3  Products — Digital Compliance Templates

3.1  Nature of Products

SIAC's Products are digital documents delivered electronically. They include white-label AML/CTF program templates, operational registers, checklists, and supporting compliance resources for the following reporting entity sectors under the AML/CTF Amendment Act 2024 (Cth), operative from 1 July 2026:

  • Conveyancing practices
  • Legal practices
  • Real estate agencies
  • Accounting and professional services firms
  • Jewellers, precious metals and bullion dealers

Products are compliance frameworks only. They are not legal advice, regulatory advice, or professional services. See clause 9 and the Product Disclaimer for the full scope of what Products are and are not.

3.2  Product Descriptions and Accuracy

SIAC takes care to ensure Product descriptions on the Website are accurate as at the date of publication. However, SIAC does not warrant that descriptions are exhaustive or that Products will address every specific circumstance of every purchaser. You are responsible for assessing whether a Product is suitable for your needs before purchasing.

3.3  Updates and Currency

Products are developed by reference to the legislative and regulatory framework current at the date of publication. SIAC does not commit to update Products automatically following regulatory changes. Where significant updates are published, SIAC may make updated versions available at its discretion. It is your responsibility to ensure your AML/CTF program remains current.

4  Purchasing, Payment, and Delivery

4.1  Placing an Order

To purchase a Product, you must complete the checkout process on the Website. By submitting an order, you make a binding offer to purchase the selected Product at the price displayed. SIAC accepts your order when it sends an order confirmation to your email address.

4.2  Price and GST

All prices displayed on the Website are in Australian dollars (AUD). Unless expressly stated otherwise, prices are exclusive of Goods and Services Tax (GST). GST will be added and displayed at checkout where applicable. SIAC reserves the right to change prices at any time prior to an order being accepted. Once an order is confirmed, the price is fixed.

4.3  Payment

Payment is processed at the time of purchase. SIAC uses third-party payment processors (including Stripe or equivalent services) to handle payment transactions. By completing a purchase you agree to the payment processor's terms and authorise the charge to your nominated payment method.

SIAC does not store your full payment card details. Payment security is managed by the third-party processor in accordance with PCI DSS standards. SIAC is not liable for any loss arising from a failure or security breach at the payment processor level, except to the extent required by the Australian Consumer Law.

4.4  Delivery

Products are delivered electronically. Following payment confirmation, you will receive a download link or access to the Product via your account. It is your responsibility to ensure the email address provided at checkout is correct. SIAC is not responsible for non-delivery caused by an incorrect email address.

SIAC will make reasonable efforts to make Products available for download within a reasonable time following purchase. Technical issues causing delay will be remedied promptly once notified.

4.5  Access Period

Unless otherwise stated at the time of purchase, download access to a Product is provided for 12 months from the date of purchase. After that period SIAC may, but is not obligated to, continue to provide download access. You should download and save the Product promptly after purchase.

4.6  Failed Transactions

If a payment fails, the order will not be confirmed and no Product will be delivered. If you believe a payment has been charged but you have not received access to a Product, please contact SIAC through siac.com.au/contact promptly.

5  Refunds and Cancellations

5.1  Digital Products — General Policy

Because SIAC's Products are digital documents that are provided electronically and accessible immediately upon purchase, they are generally non-refundable once delivery has been made or download access granted. This is consistent with the nature of digital goods under the Australian Consumer Law.

5.2  Exceptions — Consumer Guarantees

Nothing in this clause overrides your rights under the Australian Consumer Law. If a Product:

  • has a major failure (for example, the downloaded file is corrupt and cannot be opened, and SIAC is unable to provide a working replacement within a reasonable time); or
  • is not as described (for example, the Product delivered is materially different from what was described at the time of purchase);

then you may be entitled to a remedy under the Australian Consumer Law, which may include a replacement, repair, or refund. Contact SIAC at siac.com.au/contact to raise a concern.

5.3  Discretionary Refunds

SIAC may, at its absolute discretion, grant a refund in circumstances not required by law — for example, where a purchase was made in clear error and the Product has not been opened or downloaded. Such refunds are granted as a matter of goodwill and do not create a precedent or obligation.

5.4  How to Request a Refund

To request a refund, contact SIAC through siac.com.au/contact within 14 days of purchase, providing your order reference number, the Product purchased, and the reason for your request. SIAC will respond within 5 business days.

6  Intellectual Property

6.1  SIAC's Intellectual Property

All intellectual property rights in the Website and in all Products — including content, structure, design, frameworks, methodologies, text, graphics, logos, and software — are owned by or licenced to SIAC and are protected by Australian and international intellectual property laws.

6.2  What You May Do

When you purchase a Product, you acquire a limited, personal, non-exclusive right to:

  • download, store, and access the Product for your own business compliance use;
  • customise and adapt the Product to develop your own firm's AML/CTF program; and
  • retain a copy for regulatory record-keeping purposes for the periods required by applicable law.

You retain full ownership of all content you generate through customisation — your risk assessments, procedural adaptations, firm-specific data, and governance records are yours.

6.3  What You Must Not Do

Without SIAC's prior written consent, you must not:

  • reproduce, distribute, publish, or make publicly available any SIAC Product or substantial portion of its content;
  • sell, transfer, assign, or sub-licence any SIAC Product to a third party as a standalone document;
  • represent any SIAC Product, in its original or minimally adapted form, as your own original work or as a complete, compliant AML/CTF program;
  • use any SIAC Product or Website content to train, develop, fine-tune, or prompt any artificial intelligence or machine learning system;
  • share purchase receipts, download links, or account credentials with persons who have not purchased access; or
  • remove or alter any SIAC copyright notice, brand attribution, or ownership statement from any Product.

6.4  Compliance Consultant Use

Compliance practitioners who adapt SIAC templates for supply to their professional clients as part of an advisory engagement may do so subject to the following:

  • Genuine, substantive customisation must be carried out for each individual client — supply of an unmodified or nominally altered template to a client is not permitted.
  • The consultant must not represent SIAC Products as original works authored by the consultant.
  • SIAC's Product Disclaimer applies to the end-use of any template by the client firm.

6.5  Website Content

All content published on the Website — including articles, guides, commentary, and resources — may not be reproduced, adapted, or distributed without SIAC's prior written consent, except as permitted by the Copyright Act 1968 (Cth) (for example, fair dealing for research or study).

7  User Accounts

7.1  Registration

Certain features of the Website may require you to create an account. When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the accuracy of your account details and notifying SIAC of any changes.

7.2  Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

  • choose a strong, unique password and not share it with any other person;
  • notify SIAC immediately at siac.com.au/contact if you suspect unauthorised access to your account; and
  • not use another person's account without their express permission.

SIAC is not liable for any loss arising from unauthorised access to your account that results from your failure to maintain the security of your credentials.

7.3  Suspension and Termination

SIAC reserves the right to suspend or terminate any account at any time, with or without notice, if SIAC reasonably believes the account has been used in breach of these Terms, for fraudulent purposes, or in any manner that may cause harm to SIAC or third parties. Termination of an account does not affect any rights or obligations that arose before termination.

8  Acceptable Use of the Website

8.1  Permitted Use

You may access and use the Website only for lawful purposes and in accordance with these Terms. You must not use the Website in any way that:

  • violates any applicable Australian or international law or regulation;
  • infringes the intellectual property rights of SIAC or any third party;
  • involves transmitting any unsolicited commercial communications (spam);
  • involves uploading or transmitting any malicious code, virus, or harmful content;
  • attempts to gain unauthorised access to any part of the Website or its underlying systems;
  • interferes with or disrupts the integrity or performance of the Website; or
  • scrapes, crawls, or systematically extracts data from the Website without SIAC's written consent.

8.2  Automated Tools and AI

You must not use any automated tool, script, bot, web crawler, or artificial intelligence system to access, extract, index, or process Website content — including Product content accessed following purchase — without SIAC's prior written consent.

8.3  Third-Party Links

The Website may contain links to third-party websites for convenience. SIAC does not endorse, control, or accept responsibility for the content, privacy practices, or products of any linked third-party website. Accessing third-party websites is at your own risk and subject to those websites' own terms.

9  No Legal Advice — Compliance Templates Only

IMPORTANT: Nothing on this Website or in any SIAC Product constitutes legal advice, financial advice, regulatory advice, or any other form of professional advice. SIAC is not your lawyer, compliance officer, or financial adviser.

SIAC Products are compliance frameworks developed from publicly available legislative and regulatory sources. They are designed to assist reporting entities in understanding and documenting their AML/CTF obligations — they are not tailored advice for any specific firm's circumstances.

Before adopting any SIAC template as your AML/CTF program you should:

  • assess whether the template is appropriate for your specific business model, risk profile, and designated service type;
  • complete the enterprise-wide ML/TF risk assessment with your firm's own risk scores and risk appetite;
  • customise all procedures to reflect how your business actually operates; and
  • seek independent legal, regulatory, or professional advice if you have any doubt about your obligations or the adequacy of your program.

10  Limitation of Liability

10.1  Exclusion of Liability

To the maximum extent permitted by law, SIAC and its contributors, officers, employees, and contractors exclude all liability for any loss, damage, cost, expense, or other consequence of any kind arising from or in connection with:

  • your access to or use of, or inability to access or use, the Website or any Product;
  • any reliance on Website content or Product content for any purpose, including compliance with legal or regulatory obligations;
  • any failure of any Product to be complete, accurate, current, or adequate for your specific needs;
  • any regulatory enforcement action, penalty, infringement notice, or other consequence arising from your AML/CTF compliance posture;
  • any unauthorised access to or alteration of your data or transmissions;
  • any technical fault, interruption, or unavailability of the Website;
  • any third-party website linked from the Website; or
  • any error, inaccuracy, or omission in any Product, including any failure to reflect regulatory changes after the Product's effective date.

10.2  Cap on Liability

To the extent that liability cannot be excluded under the Australian Consumer Law or other non-excludable law, SIAC's total liability to you for any claim arising out of or in connection with these Terms, the Website, or any Product is limited to the total amount paid by you for the relevant Product in the 12 months preceding the claim.

10.3  No Guarantee of Website Availability

SIAC does not warrant that the Website will be available at all times, free of errors or interruptions, or that any content or Product will remain accessible indefinitely. SIAC may modify, suspend, or discontinue any part of the Website at any time without notice.

10.4  Consumer Law Savings

Nothing in these Terms excludes, restricts, or modifies any right, remedy, or guarantee that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) or any other non-excludable statute. Where a consumer guarantee applies, SIAC's liability is limited to the extent permitted — for goods, to replacement or repair; for services, to resupply or payment of the cost of resupply.

11  Indemnity

You agree to indemnify, defend, and hold harmless SIAC and its contributors, officers, employees, and contractors from and against any claim, demand, loss, damage, cost, expense (including reasonable legal fees), or liability arising from or in connection with:

  • your breach of these Terms;
  • your use of the Website or any Product in a manner not permitted by these Terms;
  • any misrepresentation you make to SIAC or any third party in connection with a Product or the Website;
  • your violation of any applicable law or the rights of any third party; or
  • any claim by a third party arising from your use or distribution of a Product.

12  Privacy

SIAC collects and handles personal information in accordance with its Privacy Policy and the Privacy Act 1988 (Cth). By using the Website and purchasing Products, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

13  Communications and Marketing

13.1  Transactional Communications

By completing a purchase or submitting an enquiry, you consent to receiving transactional communications from SIAC related to your order, account, or enquiry — including order confirmations, download links, and support responses. These communications are necessary for the provision of the service.

13.2  Marketing Communications

SIAC may send you marketing communications about new Products, regulatory updates, and advisory resources. In accordance with the Spam Act 2003 (Cth), SIAC will only send marketing communications where you have provided express or inferred consent. You may opt out at any time by:

  • clicking the unsubscribe link in any marketing email; or
  • contacting SIAC at siac.com.au/contact.

Opting out of marketing communications does not affect transactional communications related to an active order or account.

14  Variation of Terms

SIAC reserves the right to update or modify these Terms at any time. Changes will take effect when the updated Terms are published on the Website. SIAC will use reasonable efforts to notify registered users of material changes by email.

Your continued use of the Website or purchase of any Product after changes are published constitutes your acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Website. Changes do not affect rights and obligations that arose under the previous Terms before the date of change.

15  Governing Law and Dispute Resolution

15.1  Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising under or in connection with these Terms.

15.2  Dispute Resolution

Before commencing any legal proceedings, the parties agree to attempt to resolve any dispute through good-faith direct negotiation initiated by written notice to SIAC at siac.com.au/contact. If the dispute is not resolved within 20 business days of that notice, either party may refer the matter to mediation administered by a mediator agreed between the parties or, failing agreement within 5 business days, appointed by the Law Institute of Victoria. The costs of mediation are shared equally.

15.3  Consumer Disputes

Nothing in this clause prevents you from lodging a complaint with a relevant consumer protection body, including the Australian Competition and Consumer Commission (ACCC) or Consumer Affairs Victoria, where you have a right to do so.

16  General Provisions

16.1  Entire Agreement

These Terms, together with the Privacy Policy and the Product Disclaimer, constitute the entire agreement between you and SIAC in relation to your use of the Website and purchase of Products. They supersede all prior representations, understandings, and agreements on those subjects.

16.2  Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision is severed to the minimum extent necessary. The remaining provisions continue in full force and effect.

16.3  Waiver

A failure or delay by SIAC to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. A waiver of any breach does not constitute a waiver of any subsequent breach.

16.4  Assignment

You may not assign or transfer any rights or obligations under these Terms without SIAC's prior written consent. SIAC may assign its rights and obligations under these Terms without your consent in connection with a sale or transfer of all or substantially all of its business or assets.

16.5  Force Majeure

SIAC is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, government action, telecommunications failure, cyberattack, or other events outside SIAC's reasonable control. SIAC will notify you as soon as practicable and take reasonable steps to minimise the impact.
